Bayer Australia is delighted that the Full Federal Court of Australia yesterday (19 June 2014) dismissed appeals by Generic Health/Lupin Australia and Apotex thereby upholding the trial judge's earlier decision that Generic Health Pty Ltd and Lupin Australia Pty Ltd have infringed claims 3 and 11 of Bayer’s Australian Patent entitled "pharmaceutical combination of ethinyloestradiol and drospirenone for use as an oral contraceptive" (which covers the oral contraceptives Yasmin® and Yaz®) by marketing and selling the 3 mg drospirenone and 30 mcg ethinyloestradiol oral contraceptive, Isabelle®.
